H-1B Specialty Occupation

The classic professional visa for roles needing a bachelor degree or higher. It is capped at 85,000 a year and selected by a beneficiary-centric lottery, so each worker gets one entry regardless of how many employers register them. We time the registration and build the petition for the October start.

An uncapped visa for moves within a multinational group: L-1A for managers and executives (up to 7 years), L-1B for specialised-knowledge staff (up to 5 years). It skips the lottery entirely, with a qualifying employer and a year of overseas service.

The questions that decide your US work-visa strategy.

  • Selection is beneficiary-centric: since the recent reform each worker gets a single lottery entry regardless of how many employers register them. The annual cap is 85,000, made up of 65,000 general plus 20,000 with a US master degree or higher. Employers register in March for selections that usually start in October, and there is a registration fee per beneficiary.

  • Yes. Cap-exempt employers, such as universities and non-profit research institutions, can file outside the cap, and the uncapped L-1, O-1, and TN visas skip the lottery entirely for those who qualify. We map your eligibility across all of them before committing to a capped filing.

  • Often. An H-4 spouse may be authorised to work where the H-1B holder has an approved I-140 or qualifies for certain extensions, and an L-2 spouse is authorised to work. We file the dependent visa and the work-authorisation application together so the family can work on arrival.

  • Most can. The H-1B, L-1, and O-1 commonly anchor a PERM-based EB green-card case. We start the PERM labour certification early so the priority date locks in, file the I-140, and then the I-485 adjustment when the visa bulletin is current, running the work file and the green-card file in parallel.

  • A USMCA work visa for Canadian and Mexican professionals in listed occupations, with no cap and no lottery, renewable in 3-year increments. It is generally faster than the H-1B when the role qualifies, though the USMCA agreement itself is under periodic review, so we confirm the role is on the current list.

  • The 2024 fee rule raised the H-1B registration fee, the I-129 petition fee, and premium processing, the I-129 form was revised in early 2025 alongside the H-1B and H-2 modernisation rules, and a related rule takes effect in early 2026. The category rules themselves remain. We file under the current forms and fees and confirm them before each petition.
